Summary:

For these reasons, IT IS HEREBY ORDERED that:

1. The receivership shall remain in place as currently defined, with the Receiver having continued access to Emvest, Inc.’s financial data.

2. The Receiver shall take appropriate measures to implement an orderly dissolution of the Fund by December 31, 2008.

3. The Receiver and all interested parties shall meet and confer regarding the exact format of the Claim form.

4. Within 14 days of this Order being stamped “filed,” UMS shall provide the Receiver with the reports of historical schedules of all payments made on the loans serviced by UMS.

5. Pursuant to Civ. L. R. 66.1, the receiver shall file, serve, and make available on the web site his Eighth Verified Report and Petition for Instructions no later than February 9, 2007. Comments or objections shall be served no later than February 23, 2007. Courtesy copies of all documents shall be delivered to chambers. The matter shall be calendared for Friday, March 2, 2007, at 1:30 p.m., but unless otherwise ordered, the Court will address all issues on the briefs and without oral argument.
